Product Warranty 

Pine Valley Packaging Limited products are warranted to be free of defects in material and workmanship for 30 days from receipt of the shelter. During this period it is the responsibility of the purchaser to notify Pine Valley Packaging Limited in writing of any claimed defect. Upon investigation, and subsequent confirmation of a legitimate defect, Pine Valley Packaging Limited will at its option and expense either repair the shelter or provide a replacement, FOB the nearest Pine Valley Packaging Limited manufacturing facility.

The foregoing does not cover and Pine Valley Packaging Limited makes no warranty with respect to:

1. Failures not reported to Pine Valley Packaging Limited within (3) days of the alleged defect.
   
   
2. Failures or damage due to negligence, other than that of Pine Valley Packaging Limited, accident, abuse, improper installation, improper operation or abnormal conditions.
   
   
3. Shelter structures that have been in any way tampered with, repaired or altered by anyone other than an authorized representative of Pine Valley Packaging Limited.
   
   
4. Shelters damaged in shipment or otherwise without the fault of Pine Valley Packaging Limited.
   
   
5. Expenses incurred by the Purchaser in an attempt to correct or repair any alleged defect.
   
   
6. Any losses, costs, expenses, liabilities and damages (including but without limitation to loss of use or profits, damage to persons or property, all liabilities of the purchaser to its customers or third persons, and all other special or consequential damages), whether direct or indirect, and whether or not resulting from or contributed to by the default of negligence of Pine Valley Packaging Limited, its agents, employees or subcontractors, which might be claimed as the result of the use of failure of the product shipped.

Purchaser shall not return shelters or parts thereof alleged to be defective without the approval of Pine Valley Packaging Limited. All parts claimed defective shall be substantially manifested by the purchaser to the satisfaction of Pine Valley Packaging Limited prior to any product being returned to the factory. The Pine Valley Packaging Limited factory will not accept collect shipments without prior written approval and authorizing claim code.

Pine Valley Packaging Limited makes no further warranty, either express or implied or by trade usage in connection with the design, sale or use of its products. The liability of Pine Valley Packaging Limited on its warranty shall in no event exceed the cost of correcting the defects in the product sold or replacing the same with non-defective product.

This warranty stated herein is in lieu of all other warranties expressed or implied, or merchant ability, or fitness for particular use and under no circumstances will Seller be liable for incidental or consequential damages.

Legal Conditions

The Buyer agrees to indemnify, defend, and hold Seller harmless from and against any and all claims. Causes of action, liabilities, damages, and costs and expenses incurred of any nature whatsoever (including attorney's fees) arising out of or related to the installation, use or removal of the product sold pursuant to this agreement. Said claims shall include, but shall not be limited to, any claims based on negligence, breach of warranty, product liability, personal injury or death brought by any individual or entity that comes in contact with such products, either directly or indirectly.

Patents

Any and all patents for products are held by Pine Valley Packaging Limited, and are represented exclusively by Pine Valley Packaging Limited under license.
